The Supreme Court of India, in Flora Elias Nahoum and Others vs. Idrish Ali Laskar, has held that in a case of sub-letting, if the tenant is able to prove that he continues to retain the exclusive possession over the tenanted premises notwithstanding any third party’s induction in the tenanted premises, no case of sub-letting is made out against such tenant. Selvi and Another, has held that if on the basis of the material on record, the Court would form prima facie opinion that the accused might have committed offence, it can frame charge, though for conviction it is required to be proved beyond reasonable doubt that the accused has committed the offence. The Madurai Bench of Madras High Court, in In Re: Section 395, has held that the exhibits marked in both the Sessions Case are one and the same. In a joint trial, when common evidence is let in, the said evidence let in, in one of the sessions case, can be used in the other sessions case by retaining xerox copy of the same. The said procedure cannot be said to be unknown to law. (a) The Supreme Court of India has introduced the provision of anticipatory bail despite Section 18 of the SC/ST (Prevention of Atrocities) Act denying pre-arrest bail. (b) The Supreme Court of India has ordered the release of “Champion R. Sangma” who is alleged to be the leader of the Garo National Liberation Army from custody by holding that a person can’t be detained through a faulty and illegal process. (c) The Supreme Court of India has held that irrespective of caste or religion, any harassment of an innocent citizen is against the guarantee of the Constitution of India, 1950. (d) In a case related to mob lynching of Alimuddin for carrying of cow meat in Ramgarh district, the cow vigilantes have been sentenced to life imprisonment by a Fast Track Court. |
