1. The Supreme Court, in State of UP vs. Sunil, has held that any person can be directed to give his foot-prints for corroboration of evidence but the same cannot be considered as violation of the protection guaranteed under Article 20(3) of the Constitution of India, 1950. It may, however, be noted that non-compliance of such direction of the Court may lead to adverse inference, nevertheless, the same cannot be entertained as the sole basis of conviction. The Supreme Court, in Mukesh and Another vs. State for NCT of Delhi and Others (Nirbhaya Case), has held that the present case clearly comes within the category of ‘rarest of rare case’ where the question of any other punishment is ‘unquestionably foreclosed’ and the High Court has correctly confirmed the death penalty and this Court sees no reason to differ with the same. One of the requisites for identifying any nation as a place of doing business is, the legal framework in such a country, which should be such that it not only provides for efficient and speedy procedures for commencing a business, but also permits easy and speedy exit from it. This is extremely important for ensuring continuous channelizing of human and economic resources, thus increasing the overall productivity of the economy. Insolvency and Bankruptcy Code, 2016 (Code) aims to consolidate and amend laws, relating to insolvency resolution of companies and limited liability entities, partnerships and individuals, which were previously contained in various enactments, into a single legislation. The main focus of this legislation is at providing resolution in a time bound manner for maximization of value of assets. The Code brings a paradigm shift from the existing‘debtor in possession’ to a ‘creditor in control’ regime. Details can be found on |
