1. The Supreme Court in  K.V. Prakash Babu versus State of Karnataka held that solely because the husband is involved in an extra-marital relationship and there is some suspicion in the mind of wife cannot be regarded as mental cruelty which could attract Section 498A/306 of Indian Penal Code. Sharmila Shivram Shetty while deciding whether an appeal under Section 19(1) of the Family Courts Act, 1984 will be governed by the period of limitation prescribed under Section 19(3) of the same act or Section 28(4) of the Hindu Marriage Act, 1955 has held that a Hindu can marry 90 days after his/her marriage has been dissolved through a decree, provided no appeal is pending against the decree. Legal News

(a) The Supreme Court issued an interim order making it mandatory for all cinema theatres to play the national anthem before a movie begins during which the national flag is to be shown on the screen. The bench has issued guidelines on singing and commercial use of the National Anthem while hearing a Public Interest Litigation.  (b) A division bench of the Supreme Court has raised doubt over the correctness of an earlier judgment while deciding the issue of cross objections in an arbitral proceeding and applicability of Civil Procedure Code an arbitration appeal proceedings under Section 37 of the Arbitration and Conciliation Act, 1996. Expressing doubt, the matter has now been referred to a larger bench for reconsideration. (c) The Supreme Court rejected an application seeking to make the singing of National Anthem mandatory in all the subordinate courts, district courts and higher courts including the Supreme Court on technical grounds.  (d) Justice Jagdish Singh Khehar will be the 44th Chief Justice of India and will be sworn in as Chief Justice of India on January 4, 2017.  (e) The Bombay High Court through its registry has directed all lower courts to accept demand drafts and cheques for the purpose of payments of bail bonds in response to the demonitization.
